PresellPageMan Advertiser and Publisher Agreement

Agreement between the advertiser (you) and the advertising broker (aka PresellPageMan, short “broker”)

Content Hosting Broker duties

• Broker will list possible content hosts which are sites for hosting marketing pages (aka “Presell Pages“) on the broker’s www.presellpageman.com

• Broker will list specific technical stats about the content hosts. These stats are queried on an ongoing basis from various search engines and other sources. Although this process is repeated regularly there’s no guarantee whatsoever to the accuracy of these stats for any give time.

• Broker will list specific technical stats about the content hosts only in a clustered accuracy. This is done to avoid identification down-tracking by competitors and search engines. In any case the accuracy of the technical stats listed shall allow a brief classification of the site and do not serve as up-to date or exact information to identify a site. The in-accuracy of technical values especially affects all sorts of backlink counts, Alexa traffic count, number of pages and related keywords.

• Broker does not list any page rank values and page rank values are not part of the offered content hosting offer. No guarantees whatsoever nor refunds will be granted based on status or changes of page rank, as it merely serves an informational purpose and is not basis of the contract between Broker and Advertiser.

• Broker will never under any circumstances reveal the identity of the advertiser to anybody except the publisher by specifying the content to host which can help in identifying the advertiser by links to his site.

• Broker will use all reasonable methods to keep the identity of advertiser, publisher and inventory secret.

Content Hosting Advertiser duties

• Advertiser must review his placement for suitability within 24 hours after placement and respond within concern or change requests within that time span via the contact form which ensures exact logging of time and avoids any spam trap troubles.

• Advertiser agrees to pay placement feeds for Presell Pages upfront in advance in the agreed term of 1, 6, 12 months or any other placement term agreed to in written. Only full pre-paid Presell Pages will get hosted.

• Advertiser may not under any circumstances reveal the identity of the publishing host to to anybody in written or verbal form

• Advertiser must obey the current requirements for websites linked from Presell Pages and may not under any circumstances change the linked website’s content or structure after approval so that it violates these requirements. If in doubt about fulfilling these requirements only a written approval (e-mail) by the broker after a manual review is sufficient.

• Any violation results in immediate termination of contract with the advertiser, removal of his Presell Pages and links to him and withholding of all advertising fees paid upfront so far for all Presell Pages hosted by broker.

• Advertiser may not under any circumstances contact the publisher directly or indirectly (by means of using another contact person or company) for going around the broker – e.g. by contacting publishers directly via their site as soon as it’s known to advertiser.

• Any violation by the advertiser results in immediate termination of contract with the advertiser, removal of his Presell Pages and withholding of all advertising fees paid upfront so far for all Presell Pages hosted by broker.

• Publisher may not under any circumstances contact the advertiser for going around the broker – e.g. by contacting advertiser directly via their site as soon as it’s known to the publisher.

• Any violation by the publisher results in immediate termination of contract with the publisher, withholding of all publisher commissions due for all Presell Pages hosted for the broker.

(general rules for staying “below the radar“)

• Broker may under no circumstances reveal to anybody the fact that he is selling pre sell pages or text link ads in “public”. The term “public” refers to web site publications, newsletters, messageboards/chatrooms/forums as well as all personally spoken information (conferences, phone calls)

• Publisher may under no circumstances reveal to anybody

• Advertiser may under no circumstances reveal to anybody
  the fact that he is ordering pre sell pages or text link ads in “public”. The term “public” refers to web site publications, newsletters, messageboards/chatrooms/forums as well as all personally spoken information (conferences, phone calls)

• Broker and publisher may under no circumstances reveal to anybody
  the fact they are in an advertising business relation

• Advertiser and Broker may under no circumstances reveal to anybody
  the fact they are in an advertising business relation, except by referring to the broker’s site presellpageman.com by using text links like http://www.presellpageman.com not revealing and personal contact information about advertiser, broker or publisher

• Advertiser agrees to not link back to the Presell Page from his own website (reciprocate the link) this would make it very easy to detect the Presell Page and also void the effect for the advertiser, devaluing the investment

• Advertiser agrees not to link to the Presell Page from the exact same web sites as his own website is linked. This co-citation scheme would make it very easy to detect them as “related websites”, and also void the Presell Page effect for the advertiser

• Advertiser agrees not to use any kind of link-farm, link-network or link-spam tool on his Presell Pages. This means the advertiser will not link to the Presell Page from automated link networks (e.g. Link Vault, ReceiveLinks or Digitalpoint COOP), not link to the Presell Page from spammy mass replicated automated link directories (e.g. GotLinks and hundreds of similar tools) and agrees not to use any kind of spam linking to the Presell Page like guestbook signing, forum spamming or any other kind of (semi-)automated mass-creation of low quality spam links. These linking tactics not only do not work in Google, but dimish the value of the original content created for the Presell Page as well and also void the Presell Page effect for the advertiser as link farms and link networks are easily detected over a couple of months.

• Advertiser agrees to report to Broker and cure discrepancies to the above mentioned linking practices to help keep the Presell Page hosting sites under the radar and maximize advertiser’s investment’s value.

• Any violation by the advertiser results in immediate termination of contract with the advertiser, removal of his Presell Pages and withholding of all advertising fees paid upfront so far for all Presell Pages hosted by broker.

• Any violation by the publisher results in immediate termination of contract with the publisher, withholding of all publisher commissions due for all Presell Pages hosted for the broker.

Refund policy

• If the advertiser is not 100% satisfied with the first Presell Page or the first 25% of Presell Pages of an of an order batch (whatever is higher), he can request a full refund before the order batch is completed. This refund shall be requested within 24 hours after the Presell Page placement url has been communicated to the advertiser by the broker.

• The advertiser can cancel the payment subscription anytime himself. Subscription cancels are required latest 14 days before their renewal date for monthly payment terms, 60 days before renewal date for yearly or longer payment terms and 30 days before renewal date for all other payment terms.

• A payment term is considered renewed when the payment is due and was not cancelled within above mentioned cancel periods ahead of due date. A payment term here refers to the commitment made initially, so it is usually one month, three months, six months or twelve months.

• No refunds are given for early cancellation of a started payment term.

• Permanent placements are guaranteed for 8 months of placement for which a replacement is given if pages are removed before. No changes can be done to permanent placements after the initial placement.

• Due to a variety of factors the Presell Page placement can take up to 3 full weeks. The effective date of the page starts when the page goes live and it’s placement url is communicated to the advertiser by the broker. Only a Presell Page placement delay longer than 3 weeks allows for a refund request before placement. Before 3 weeks or page placement no refunds are possible.

• Failure to charge a renewal payment successfully (i.e. due to an expired credit card) does not change the invoice or the due date, nor does it lengthen the current term or cancel period.

• The advertiser agrees to cure the reason for unsuccessful charges within 48 hours of notification by the billing system (i.e. PayPal) and/or the broker.

• Any open invoice older than 48 hours will result in a removal of all links and/or Presell Pages as well as reuse of that Presell Page for other advertisers

Acceptance of terms & conditions

Use of the web site presellpageman.com by Advertiser and Publisher, continued payment of advertising services brokered through Broker and continued publishing of advertising services brokered through Broker imply acceptance of all the terms & conditions listed within 14 days after publishing of changed terms and conditions.
